DOWNLOADING FILES AND ASSOCIATED LICENSES

When fles and Images are made available as downloadable electronic files, their usage is subject to the conditions of an agreement.

There are 3 types of agreement:

Personal-Use

Royalty-Free

Rights-Managed.

The following is a guide to the 3 types of agreement. These are merely guides (i.e. they are not the agreement), full details of which can be provided or can be viewed on the www.Photoshelter.com website. 

 

GUIDE TO PERSONAL-USE DOWNLOAD AGREEMENT

By purchasing the selected image(s) the purchaser agrees that he/she is not acquiring any right, title or interest in or to the Images(s) or any associated copyrights, other then the right to hold and use the Images(s) for personal, non-commercial purposes.

The purchaser agrees that he/she will not scan, copy, duplicate, distribute or otherwise reproduce the Images(s).

The purchaser agrees that he/she will not use the Images for any commercial purpose, without the express written consent of the photographer.

The purchaser agrees that he/she will indemnify PhotoShelter and its affiliates, officers, members, managers, employees and agents against any claims, losses or damages incurred as a result of or in connection with his/her breach of the above restrictions.

 

GUIDE TO ROYALTY-FREE (RF) LICENSE

RF images are typically less expensive than RM images as they can be marketed to a broader client base. But, because there are few restrictions on the usage of a Royalty-Free image, there is the potential that it can surface in very different places (with potential advertising conflicts).

Prices of stock Royalty-Free images range from $20 to $200 (£15 to £150). Actual prices are shown when you click on "Buy image".

Licensee has the non-exclusive, non-transferable, non-sublicensable right to Reproduce the Licensed Material an unlimited number of times in any and all media for the following "Permitted Uses":

Advertising and promotional materials;

Broadcast and theatrical exhibitions;

Print publications and physical products;

Electronic publications including website design, up to a maximum resolution of 72dpi; and

Any other uses approved by the Licensor in the Invoice or otherwise in writing.

Licensee has the right to have the Licensed Material Reproduced by subcontractors of Licensee, provided that Licensee ensures that such subcontractors agree to abide by the provisions of thE Agreement.

Licensee may alter, crop, manipulate and create derivative works of the Licensed Material.

Licensee's rights to the Licensed Material are worldwide and perpetual.

Licensee may store the Licensed Material in a digital library, network configuration or similar arrangement to allow the Licensed Material to be viewed by employees, partners and clients of Licensee, but under no circumstance may the Licensed Material ever be used by more than 10 Users unless otherwise provided in writing by the Licensor.

Licensee may not sublicense, sell, assign, convey or transfer the Agreement or any of its rights under this Agreement but Licensee may sell or license derivative works incorporating the Licensed Material. However, Licensee may not include the Licensed Material in an electronic template intended to be Reproduced by third parties on electronic or printed products.

Licensee may not sell, license or distribute any derivative work containing the Licensed Material in a way that would allow a third party to download, extract or access the Licensed Material as a standalone file.

Licensed Material shall not be incorporated into a logo, trademark or service mark.

Licensee may not post the Licensed Material online in a downloadable format or enable it to be distributed via mobile telephone devices.

Licensee must retain the copyright symbol, the name of Licensor or such other credit information, if any, provided in the invoice, the Licensed Material's identification number and any other information as may be invisibly embedded in the electronic file containing the original Licensed Material.

Licensee must abide by any restriction on use notified to it by Licensor before or at the time of delivery of the Licensed Material, either in the Invoice, information accompanying the Licensed Material or otherwise.

If any Licensed Material is Reproduced in an editorial manner, Licensor's name or, such other credit information, if any, provided in such Invoice, must appear adjacent to the Licensed Material in the credit line accompanying the Licensed Material.

No ownership or copyright in any Licensed Material shall pass to Licensee by the issuance of the license contained in the Agreement. Except as expressly stated in the Agreement, Licensor grants Licensee no right or license, express or implied, to the Licensed Material.

 

GUIDE TO RIGHTS-MANAGED (RM) LICENSE

RM images are typically more expensive than RM images as the client base is selective. Because there are restrictions on the usage of Rights-Managed images, and the usage is carefully and selectively managed, there is little risk that it can surface in very different places, so avoiding advertising conflicts.

Prices of Rights-Managed images are industry-standard, automatically calculated by fotoquote® and are based on type of usage, region, country etc. Prices start at approximately $150 (£100). Actual price will be shown when information relating to usage has been selected.

Licensor grants to Licensee a non-exclusive, non-assignable and non-sub licensable right to Reproduce the Licensed Material. This right may be exercised by subcontractors of Licensee, provided that such subcontractors agree to abide by the terms of the Agreement.

Use of the Licensed Material is strictly limited to the use, medium, period of time, print run, placement, size of image, territory and any other restrictions specified. Licensee may utilize the Licensed Material in any production process that may be necessary for the specified use.

Licensed Material shall not be incorporated into a logo, trademark or service mark.

Licensed Material shall not be used contrary to any restriction on use that is notified to Licensee prior to or at the time the Licensed Material is delivered to Licensee. Such restrictions may be included in the information provided with the Licensed Material, or in any other communication by the Licensor. Any such restriction provided to the Licensee shall be incorporated in this Agreement by reference.

Upon reasonable notice, Licensor may inspect any records, accounts and books relating to the Reproduction of any of the Licensed Material to ensure that the Licensed Material is being used in accordance with this Agreement.

No ownership or copyright in any Licensed Material shall pass to Licensee by the issuance of the license. Except as expressly stated in this Agreement, Licensor grants Licensee no right or license, express or implied, to the Licensed Material.

We prefer to spend time with you to discuss details of what prints you would like. If you feel confident in doing this yourself, prints can be ordered directly from your gallery. Simply select the image and click "Add to Cart". Then select the print size and finish. Pay through paypal and your prints will be shipped directly to you in a matter of days.

A GUIDE TO PRINT FINISHES

 Matte finish is a highly textured print finish that resists fingerprints and scratches. It has little shine and does not reflect light.

Many photographers use matte finishes for wallet prints because they usually get handled more than normal.

 Some also use it for poster-sized prints to reduce glare.

 
Lustre finish is not as shiny as glossy, but not as flat (dull) as matte finish paper. It has good color depth and a textured finish (some call it "pebbled") that hides fingerprints. Most portraits and wedding photos are typically printed on Lustre finish paper.
 
 
Glossy finish is the shiny, rich-looking paper most people are traditionally used to. It tends to show fine detail better, but also shows fingerprints and flaws. It is also prone to glare/reflections under directional light. It is the best for evenly lit high quality prints with no flaws.

  
Metallic finish is a high gloss finish with very saturated colors. It appears as though the image is printed on metal (It almost compares to the back side of aluminum foil). Images tend to really "pop" when they are done on metallic paper. However, bright areas have a tendency to be washed-out so the subject needs to have been evenly lit.

Metal prints are actually printed directly onto Aluminum up to 40"x60". These are the highest quality and colors are stunning. The finish is very durable (you can wash fingerprints off). They are the most expensive, but last the longest and don't need framing.  It's a specialized printing process and only a couple of places in the country have mastered the technique so they are special order items not available on our standard list. Typical prices are $20 for a 4x6 or $40 for an 8x10 (call me if you are interested). If the photograph is good there is no better way to show it off.
